Missouri Governor Jay Nixon Asks Legislature to Repeal Law Regulating Digital Communications Between Teachers and Students

JEFFERSON CITY, Mo. - Gov. Jay Nixon today announced that he will ask the General Assembly to repeal specific provisions concerning teacher-student communications that were included in Senate Bill 54, which was passed unanimously by both the House of Representatives and the Senate earlier this year.  The Governor will ask the General Assembly to repeal these specific provisions during the special session that begins Sept. 6. In addition, Gov. Nixon will seek input from various stakeholders, including parents and classroom teachers.
"First and foremost, our top concern and priority is and always will be protecting children across Missouri, and making sure students receive the quality education they need and deserve," Gov. Nixon said.  "In a digital world, we must recognize that social media can be an important tool for teaching and learning.  At the same time, we must be vigilant about threats posed to students through the Internet and other means. Because of confusion and concern among educators, students and families over this specific provision of Senate Bill 54, I will ask the General Assembly to repeal that particular section, while preserving other vital protections included in the bill.  In addition, I will be asking for input on this issue from teachers, parents and other stakeholders."
Specifically, Gov. Nixon will ask the General Assembly to repeal statute 162.069, sections 1 through 4, which require school districts to adopt by Jan. 1, 2012, a policy on student-teacher communications and which specifically addresses electronic communications between school employees and students.  Under the state constitution, the Governor can add an item to the call for a special session by issuing a proclamation once the session has convened.
Senate Bill 54, known as the Amy Hestir Student Protection Act, includes a number of additional provisions that protect students from sexual misconduct and will not be included in this addition to the special session call.  Those provisions include:
  • Requiring disclosure of substantiated allegations of sexual misconduct by a former employee of a school to a public school that inquires about potentially hiring the employee;
  • Requiring that reports of sexual misconduct by a teacher or employee be forwarded to the Department of Social Services within 24 hours for an investigation;
  • Requiring annual background checks of teachers
  • Requiring immediate suspension of school employees upon substantiation of sexual misconduct;
  • Banning registered sex offenders from running for and serving on school boards;
  • Requiring school districts to include training on the signs of sexual abuse in employee training;
  • Establishing that crimes relating to sexual misconduct are a basis for discipline and the revocation of teachers' licenses; and
  • Creating a Task Force on the Prevention of Sexual Abuse of Children ("Erin's Law").
Senate Bill 54 passed unanimously in both the House of Representatives and the Senate during the regular legislative session.  Numerous groups testified in support of the bill, including the Missouri National Education Association, the Missouri State Teachers Association, the Missouri School Boards Association, the School Administrators Coalition, Missouri Eagle Forum, Cooperating School Districts of Greater Kansas City and the Partnership for Children.
"Although this legislation included a number of vital provisions, it's clear this one particular section is causing substantial confusion and concern among teachers, students and families," Gov. Nixon said.  "For that reason, it's important that we repeal this specific language during the upcoming special session, while we continue to work together to ensure the safety and protection of Missouri's children."

Missouri Department of Elementary and Secondary Education names Kristen Merrell "Teacher of the Year"

Kristen Merrell grew up with dreams of becoming a teacher.  From setting up classrooms full of teddy bears, alligators and other stuffed animals as a young child, and later tutoring classmates during her high school years, her career path was destined from an early age.

Currently a third-grade teacher at Lee’s Summit Elementary School known for the
enthusiasm and care she shows her students, Merrell has been selected as the Missouri Teacher of the Year for 2011-12, state education officials announced today.  The school celebrated the announcement with a surprise assembly this morning.
A selection committee appointed by the Department of Elementary and Secondary Education chose Merrell for the award on Monday.  She automatically becomes Missouri’s nominee for the National Teacher of the Year program.
Merrell has taught at Lee’s Summit Elementary since 2004 and has served in a variety of leadership roles.  She has been a literacy lead teacher, a professional learning communities coach, and a member of the math essential skills and curriculum assessment teams.
In her written application, Merrell told stories of numerous students who have inspired her during her years as a professional educator.
“Although the details of their stories are unique, my goal is to have the outcome always be the same – a young life transformed and influenced by a teacher who took the time to care,” she said.  “I believe in kids. When I smile at them, they know I mean it. I don’t give up on them, and they don’t give up on themselves.”
Patricia Buie, a member of the Lee’s Summit School District’s board of education, has spent time volunteering in Merrell’s classroom.  In a letter of recommendation, Buie said that Merrell has “boundless energy, matched only by her incredible passion for teaching and learning.”
“She used differentiated instruction before it became a buzz word, and seemed to always intuitively understand that her students come to her with a multitude of learning styles and needs,” Buie said.
Merrell said that caring about her students’ personal lives enables her to maximize their potential.  She employs nonstop reflection and planning on a daily basis to help her see the “big picture” of her classroom.
“While making data-driven decisions about curriculum is critical to ensuring student progress, so is knowing each of my students and what individual motivational strategies might best combine with the data to propel that student to his or her highest potential,” she said.
Katie Collier, Merrell’s former principal at Lee’s Summit Elementary, said in a letter of recommendation that Merrell is a prime example of why educators should be celebrated because “she educates our youth with a perfect balance of art, science and heart.”
“Consistently, year after year Mrs. Merrell’s students achieve at high levels based on building, district and state standards,” Collier said.  “These results of student learning serve as (evidence) of the standard of excellence she sets for students.”
Merrell said she believes in celebrating her students’ learning both inside the school and out in the community.  She recently worked with a local newspaper to have her students’ letters to the editor published. 
“The students were jazzed to have this real world experience in writing, and they felt like stars!” she said.  “The parents were pleased and requested extra copies of the paper to mail to aunts, uncles and grandparents.  The community was impressed to read such varied and interesting works by eight- and nine-year-olds.”
Merrell received a bachelor’s degree in elementary education from the University of Missouri-Kansas City and a master’s degree in teaching from Webster University.  She is currently working on an education specialist degree in school administration at the University of Central Missouri. 
She and the five Teacher of the Year finalists will be honored at a banquet Oct. 26 in Jefferson City. Each teacher will receive cash awards and other prizes.
The Department conducts the Missouri Teacher of the Year program with financial support provided by the Boeing Company of St. Louis.

Big Catfish in Missouri's seldom fished streams by Bill Graham

KANSAS CITY Mo -- Sometimes big fish swim in seemingly small waters, such as the streams flowing through the rolling hills of northwest Missouri. It’s not always obvious looking down on brownish rivers such as the Platte, Nodaway, Grand and One Hundred and Two, but huge flathead, blue and channel catfish lurk in their riverbed’s deep holes.
Those anglers willing to do some paddling can enjoy a solitary experience and the chance to catch a trophy catfish, said Tory Mason, a Missouri Department of Cconservation (MDC) fisheries biologist who also fishes as a hobby.
“I’ve almost always caught fish just using rod and reel on canoe trips,” Mason said. “I’ve never run into any other people when I’m out floating on these rivers.”
As a biologist conducting catfish population surveys on rivers, he’s also encountered some behemoths such as a blue catfish in the lower Nodaway River that he estimates topped 80 pounds. Catfish often enter streams in the state’s northwest region from the Missouri River and swim upstream into the current. Perhaps that fish was one.
Sometimes very large catfish are caught far from the Missouri River in the upper reaches of streams that once drained prairies and now flow through farm land.
Josh Hendrix of Bolckow caught a mammoth flathead catfish in June on a trotline baited with chub minnows on the One Hundred and Two River in Andrew County. It was far too big for his scale’s top weight of 50 pounds, and he estimated the weight at 75 pounds.
“I could barely lift it,” Hendrix said.
But catching big catfish in prairie rivers usually requires some angler effort to reach the more remote segments of streams, said Conservation Agent Michele Holland, who is based in Andrew County. The fish congregate in deep holes scoured by currents, and float fishing from johnboats or canoes is the best way to reach those spots. Getting boats up and down steep banks, even where public access is available, can be tricky.
“It can be a workout,” Holland said.
MDC offers public access to rivers at conservation areas but boat ramps for launching large craft may not be available at generally shallow, upland streams. For instance, the Happy Holler Conservation Area north of Savannah offers bank access to the One Hundred and Two River but no boat ramps. Some rivers that are deeper in their lower reaches, such as the Platte River, do have boat ramps. But anglers should be aware that flooding can sometimes temporarily cover those ramps with mud and silt.
Anglers can search for accesses on the MDC website at www.missouriconservation.org.  Scroll down and on the right is a “Regs and Areas” box with options. Select “Conservation Areas.” Then select the county where you plan to fish and click “Find.” A list of conservation areas and river accesses will appear. Select the area to see what type of access is available.
Once on the river, finding fish can be pretty simple, Mason said.
“Your paddle will hit bottom for half the float,” he said. “Then you’ll come to a spot where you can’t hit bottom. That’s where the fish are. You can eliminate a lot of fishless water that way.”
June and July are prime months for catching catfish in prairie streams. But August into autumn can be productive, too, because cooler weather and rains that cause a rise in water flow trigger fish to feed more actively.
Mason likes to fish with dip or stink baits in late summer.
Autumn also brings on fall color and smaller streams often wind through scenic areas, Holland said, including the segment of the One Hundred and Two River that passes through the Happy Holler Conservation Area.
“It can be a pretty float,” she said. “We usually don’t run into anyone else on the water, even on a Saturday."

Record Striper Bass Caught By Rookie Bruce Cunningham


GAINESVILLE–“You’re not going to believe this until you try it.”
According to Bruce Cunningham, that is what his brothers said when trying to persuade him to go fishing with them in June. Brad and Brock Cunningham had discovered the excitement of catching striped bass at Bull Shoals Lake, and they wanted to share it with their older brother.
Bruce decided to play along, and at 1 a.m. June 18 he found himself holding a new state-record striper weighing in at 60 pounds, 9 ounces. The catch nudged aside the previous pole-and-line record, a 58-pounder caught by John West, of Republic, in July 2010.
Cunningham, 30, of Fordland, was fishing from a boat in the upper reaches of Bull Shoals when the record fish grabbed the large plastic minnow he was casting. He was fishing in about 40 feet of water.
The fish was 47 inches long and had a girth of slightly more than 36 inches.
The two younger Cunningham brothers were rewarded for sharing their discovery. They boated several other stripers that topped 40 pounds the night Bruce caught his.
Striped bass (Morone saxatilis) are native to the Atlantic Ocean but make spawning runs up rivers along the East Coast to spawn. These ocean-run striped bass can grow to 6 feet long and 125 pounds. Although not native to Missouri, “stripers” have adapted well to fresh-water reservoirs and streams. However, they do not grow as large in fresh water.
Bull Shoals is Missouri’s striped-bass mecca right now, thanks to a one-time stocking by the Arkansas Game and Fish Commission in 1998. That year, a mix-up resulted in the stocking of 19,000 striped bass. Ken Shirley, district fisheries supervisor for the Arkansas Game and Fish Commission, said the fish were intended for Norfork Lake.
“We were expecting a shipment of walleye for Bull Shoals,” said Shirley. “A summer helper called to tell us that a shipment of fish had arrived at the hatchery and asked where they were supposed to go. We thought it was the walleyes, so we told him to take them to Bull Shoals. It turned out they were striped bass.”
Shirley said the surviving fish from that mistaken stocking now weigh between 30 and 60 pounds and are near the end of their lives. He expects the boom in trophy striper fishing at Bull Shoals to taper off over the next four or five years as fish from the accidental stocking slowly disappear.
